TERMS AND CONDITIONS
1. DEFINITIONS
In these terms and conditions:
a) ”us” "we” and ”our” meansRomulus Wimbledon Ltd (company registration number 13068908) whose registeredoffice is at Sandford House, 10 Maynard Close, London, SW6 2DB.
b) ” vehicle” means the vehicle whichenters the Car Park and includes any mechanical device on wheels or tracks, itsequipment, and accessories.
c) “CarPark” means each parking facility within Centre Court Shopping Centre.
d) “Fees” means the fees payable byeach User to use the Car Park (as varied by us from time to time), if any.
e) “Permit/Season Pass” means a ticket permitting a User to park their vehicle inthe Car Park.
f) “TariffBoard” means any board or notice at the Car Park displaying the Fees.
g) “User”means any individual who uses the Car Park to park a vehicle.
You acknowledge that you enter this contract with us basedon these Terms and Conditions not only on behalf of yourself, but also onbehalf of any passengers in the vehicles and the legal owner of the vehicle.This means that we may enforce these Terms and Conditions against you or anypassenger or legal owner of the vehicle. Equally, you, any passenger and thelegal owner of the vehicle can enforce these Terms and Conditions against us.
3 OUR LIABILITIES
We are responsible for using reasonable skill and care inthe operation of the Car Park. However, that responsibility is limited, and weare only liable as set out in (a), (b) and (c) below and have no otherliability to you.
a) We must operate the Car Park with reasonableskill and care. If we do not, we are only responsible for direct loss or damagea User suffers as a foreseeable result of its breach of its obligations or itsnegligence or the negligence of our employees, agents, or subcontractors.
b) We do not exclude or limit in anyway its liability for death or personal injury caused by its negligence or thenegligence of its employees, agents, or subcontractors.
c) Although we must meet theobligations set out at clauses 3a) and 3b), the Car Park is open to others, andwe cannot guarantee that third parties will not enter the Car Park and causedamage to property and/or engage in criminal activity. Accordingly, each Userparks their vehicle in the Car Park at their own risk. We cannot and do notguarantee the security of the vehicle and/or its contents.
4 CLAIMS AND COMPLAINTS PROCEDURE
(a) If your vehicle sustains damage orcauses damage to any other vehicle or our property while in the Car Park or ifyou lose your vehicle or any of your possessions from your vehicle while it isin the Car Park, you should:
(i) Immediately either inform a memberof our staff at the Car Park or contact our staff at the control room using theintercom system or otherwise notify our centre management on 0208 944 8323
(ii) In the case of theft, immediately inform the police.
(iii) Notify you insurers promptly.
(b) If you consider that you have a claimagainst us, contact Centre Management as soon as possible of discovery of theloss, damage or theft giving full details of the occurrence.
Before submitting a claim, we askthat you satisfy yourself that the subject matter of you claim lies within theareas of our responsibility set out in condition 3.
(c) If you wish to make a claim or toregister a complaint about the service that you have received, please write, orissue an email to the Centre Management, Centre Court, 4 Queens Rd WimbledonSw19 8YA.
5. SECURITY OF YOUR VEHICLE
(a)Please ensure that before you leave the Car Park:
(i) Your vehicle is securelylocked
(ii) All of the windows of yourvehicle are securely closed; and
(iii) If your vehicle is fittedwith a vehicle alarm steering lock, or similar device that it is engaged.
(b) Where CCTV cameras are installed in any of the Car Park,they are used to assist in the proper running of the Car Park. The CCTV camerasmay also act as a deterrent to criminal activity. We are obliged by law to display signage inthe Car Park advising that CCTV cameras are in operation. However, we do notmake any representation as to the extent of coverage provided by the camerasand no guarantee is given as to the security of your vehicle in Car Parks whereCCTV is installed.
6. POSSESSIONS
(a) Wherever possible please take you possessions with youwhen you leave your vehicle.
(b) If you do leave possessions in your vehicle, you do soat your own risk. Therefore, please do not leave them where they are visible.You should lock them in the boot or in an equivalent, secure, out-of-sightstorage area within your vehicle.
(c) You are reminded that your motor insurance policy maynot cover possessions in your vehicle. It may be possible to arrange separateinsurance cover for such possessions and we encourage you to do so.
7. COURTESY TO OTHER CUSTOMERS
If you damage another customer’s vehicle you should reportthe matter to us giving the registration numbers of both vehicles. You mustalso notify the owner of the other vehicle by leaving a note on the windscreenof their vehicle providing your vehicle and contact details and other detailsthat are relevant to the incident, alternatively a note advising your contactdetails have been provided to the Centre Management Office.
8. SAFETY IN THE CAR PARK
(a) Please drive carefully in the Car Park and obey thedirectional and other signs and any directions given by our staff.
(b) Car parks can be dangerous. After you have parked yourvehicle you must proceed immediately to the nearest passenger lift, staircase,or exit, following the recommended route (if any). You must not in anycircumstances exit the Car Park by walking under a vehicle exit barrier.
(c) Do not delay your exit from the Car Park and pleasesupervise your children and pets who must be always kept under your control andsupervision in the Car Park. Children and pets must not be left in anunattended vehicle.
(d) For safety reasons you are not entitled to remain inyour vehicle in the Car Park or elsewhere in the Car Park except for thepurposes of parking or removing your vehicle.
9. TICKETS
(a) The ticket issued to you is only validfor the vehicle in respect of which it is issued. Tickets are not transferablebetween vehicles and is only valid for the Car Park in which it was issued. Aticket (including a Permit/Season Pass) does not entitle you, unless otherwisespecified, to any particular space in the Car Park or to priority over othercustomers. Upon entry to the Car Park, if you are unable to find a space foryour vehicle then you should exit immediately to prevent any parking chargesfrom arising.
(b) Pleasetake your ticket with you and do not leave it in your vehicle.
(c) If the paymachine is out of order, please use the nearest alternative machine.
(d) If you experience any problems with theticket or pay machine, please telephone 0208 944 8323 or use the intercom onthe pay on foot machine.
(e) We reserve the right to refuse torelease any vehicle for which a valid and current ticket or Permit/Season Pass,cannot be produced, until we have made reasonable enquiries. Failure to produceyour ticket will therefore delay your departure.
(f) If you cannot produce your ticket ondeparture, you will be charged at the full lost ticket rate for each 24-hourperiod or part thereof that your vehicle has been in the Car Park. The durationof the vehicle’s stay within the Car Park will in such circumstances be fullydetermined by us.
10. PARKING CONTRAVENTION
(a) Parking is restricted to motor cars,motorcycles, cycles, invalid carriages, and light vans only. Caravans,trailers, coaches, and lorries are not permitted.
(b) It isimportant to the effective management of the Car Park.
I. That you do not park within abay designated for a specific purpose when you are not entitled to do so (e.g.,parking in a space for the disabled without and appropriate disability badgedisplayed).
ii. That you park within a marked bay.
iii. That you comply with all signs in the Car Park.
iv. Permit/Season Pass users park on thelower level of the Car Park unless directed otherwise by our staff.
(c) If you do not comply with theserequirements, then we reserve the right to cancel your parking agreement withus
(d) If you incur a parking charge underthese circumstances this will be payable before exiting the Car Park.
11. ACCESS, RE-LOCATION AND CLAMPING OF VEHICLES
(a) We reserve the right to refuse theadmission of any vehicle to the Car Park for any reason whatsoever and mayremove from the Car Park or move within the Car Park any vehicle by whatevermethod we consider reasonable.
(b) We reserve the right to move vehicleswithin the Car Park, by driving or otherwise, using whatever method we considerappropriate (even, if as a consequence, damage is caused to your vehicle) tosuch extent as is reasonably necessary for the purposes of safety to persons orproperty to avoid obstruction or for the more efficient arrangement of ourparking facilities at the Car Park.
(c) We additionally reserve the right,where the Car Park has to be closed either permanently or temporarily in wholeor in part or has to be evacuated in cases of emergency, to remove any vehicleat any time to any other reasonably convenient car park within our control orotherwise as may be expedient.
(d) To the extent that it may be necessaryto do so in the exercise of the rights conferred upon us under these terms andcondition, we reserve the right to drive or otherwise take you vehicle onto apublic highway. In doing so we will take reasonable care of the vehicle.
(e) Subject to Clause 13, a vehicle whichappears to be abandoned or is left in a contravention of the regulations may beimmobilised or removed to a place of safer keeping and may eventually bedisposed of. Costs of release, removal, storage and disposal will be charged tothe vehicle owner.
12 TARRIF
(a) The Fees payable by you (as variedfrom time to time) shall be as displayed on the Tariff Board in the Car Park orwithin your Permit/Season Pass agreement. You are obliged to pay the Fees andto comply with any instructions on the Tariff Board.
(b) Overnight parking tariff is payable inaddition to any accrued daily tariff or Permit/Season Pass Fees
(c) A vehicleleft after the Car Park closes will not be released until the next trading day.
(d) Permit/Season Passes are valid onlyfor the agreed access days and times previously advised in your Permit/SeasonPass agreement, any parking above and beyond this will be charged at the normaltariff laid out on the Tariff Board in the Car Park
(e) Each Permit/Season Pass is valid onlyfor the Vehicle in respect of which it is issued. A Permit/Season Pass does notentitle a User to use any particular space in a Car Park or to priority overother Users.
13 PAYMENTAND DISPOSAL OF ABANDONED VEHICLES
(a) We reserve the right to hold yourvehicle until we have received payment for all parking charges due to us and wereserve the right to refuse to release any vehicle until those charges havebeen paid.
(b) If you intend to leave your vehicle inthe Car Park for more than 7 days, you are required to, notify us in writing ofyour intention to do so.
(c) Beforeproceeding with the disposal of abandoned vehicles we will:
i. Make will undertake the necessaryenquiries with a view to identifying andcontacting the registered owner of the vehicle in question.
ii. Give 28 days’ notice of ourintention to do so to the registered owner by pre-paid post addressed to theregistered owners last known address.
e) Abandoned vehicles will be sold byauction whenever practicable and the proceeds of sale will be applied in andtowards satisfaction of all sums owing to us together with the expenses of saleand in connection with such sale, we shall be entitled to charge reasonablegarage charges in respect of the period during which the vehicle is in ourpossession.
f) Any balance of these salesproceedings remaining after satisfaction of such sums shall be held by us onbehalf of the registered owner of the vehicle and paid over on proof ofentitlement.
14 PROHIBITEDACTIVITIES
(a) You must not tow any vehicle into theCar Park except as part of the services offered by persons authorised by us andno work on nor cleaning of vehicles by you, or your agent other than withoutprior specific permission from us is permitted in the Car Park. In the event ofvehicle breakdown, you must contact the attendant to ensure that your vehicleremoval or repair is organised without causing disruption, damage or danger toany other person or property in the Car Park.
(b) The Car Park cannot be used foradvertising, trading, camping, cooking, sleeping, washing or servicingvehicles. Fuel tanks may not be emptied or filled. No naked flames arepermitted.
(c) No activity in connection with theselling, hiring or other disposal of vehicles or good or services shall becarried out in the Car Park without our prior specific written permission.
(d) Smoking isprohibited by law in this Car Park.
(e) Electric vehicles may only be chargedin the designated electric charging bays and use of any other power points arestrictly prohibited.
15 GENERAL
(a) These terms and conditions govern youruse of the Car Park. Please read them carefully. If you do not wish to be boundby the Terms, then please do not use the Car Park.
